How to Prepare for Legal Challenges in Drug and Alcohol Testing

Description: A former employee has notified you they are challenging a drug test result and the adverse action you took against them. You have received a request for information from their attorney. What do you do now? This is a new course designed to offer guidance and some degree of knowledge when preparing for legal challenges associated with drug and alcohol testing.
This course will explain the difference between an expert witness, an expert consultant, and which would be better suited to the situation, while exploring how to gather the appropriate documentation in preparation for an arbitration or mediation hearing, deposition, or court testimony. It is also designed to prepare collectors/BATs, MRO, or DERs to appropriately respond to requests for information, while avoiding workplace drug and alcohol testing pitfalls. The instruction provided will educate and inform drug and alcohol testing participants on best practices when providing testimony through legal proceedings relating to drug and alcohol testing processes and procedures.
NOTE: This course is intended to provide guidance if an industry participant is called to testify in any litigation or mediation proceeding. It is not intended to imply that successful completion will in any way certify or accredit the student as a drug and alcohol testing industry “expert” nor to provide “credentialing” for industry participants.
